“Be You Ever So High, the Law Is Above You”: The Burnt Cash Case Involving Justice Varma Must Not Die Down. Whose Money Was It? Who Paid It? What Was Justice Chandrachud’s Role, If Any? An FIR Must Be Registered and the Matter Investigated.

I am a Syrian Christian. We have been Christians for generations—for many, many centuries, even before the Portuguese planted Christianity, Catholicism. Our forefathers came from Syria and married local Hindu women. It is said that many Brahmins accepted the faith under the Patriarch of Antioch, namely, St. Peter.

Christians in Kerala generally support the Congress party. However, I have never been a supporter of Congress, as the party has been hijacked by one family: the Gandhi family. It is not a democratic party at all. In that sense, I have been a supporter of the BJP. That said, I am equally disappointed with the BJP on many issues, though I still support them on certain matters.

Corruption, regardless of who commits it—whether Congress or the BJP—has no justification.

In Justice Varma’s case, the government certainly failed in its sovereign duty to register an FIR and investigate the crime; nay, the government tried to cover it up. Why did the government do this? Justice Varma is just a High Court judge, but he had very powerful godfathers. Nobody was there to say it out in the open, but everybody knows it. Only after a great deal of hesitation and many second thoughts did I speak about the rumours surrounding Justice Chandrachud. Everyone in the legal and political circles in Delhi had heard the story that it was Justice Chandrachud’s money.

This is what I have heard from many people and from certain very authoritative sources in the government. It was Justice Chandrachud’s money—that was the talk in Delhi, and there can be no denial that such talk existed.

Why was there no investigation? Many people—all friends of Justice Chandrachud, such as Prashant Bhushan, Indira Jaising, Colin Gonsalves, Justice Oka, Lokur, and Muralidharan, to name a few—did not speak a word about it. None of these “blue-eyed boys” of Justice Chandrachud spoke out. Nobody asked for the registration of an FIR and a court-monitored investigation—their routine clamour.

Neither the Delhi High Court Bar Association nor the Supreme Court Bar Association asked for an investigation. None except the Allahabad High Court Advocates Association. Not a single bar association ever asked for one. Most shamefully, many came out openly in support of him, including Abhishek Manu Singhvi and Kapil Sibal.

This is undeniable corruption. When crores of rupees went up in flames because of a short circuit at the residence of a heavily guarded High Court judge—and the judge claims that someone planted the money—shouldn’t there be an investigation? Shouldn’t an FIR be registered?

Who can investigate? Can judges investigate? Investigation is a police officer’s job; no judge can conduct an investigation. An inquiry and an investigation are two different things. Investigation, inquiry, and adjudication are three distinct functions. The police alone can carry out an investigation. The court or a committee of judges can conduct an inquiry, but that is civil in nature—addressing questions like whether someone should be deprived of official work before an impeachment process is initiated, or something of that sort. The Judges (Inquiry) Act is also civil in nature. An FIR ought to have been registered, yet, to this moment, no FIR has been filed. Why?

The BJP did not ask for it, nor did Congress. Why is Rahul Gandhi silent?

We are not “rice-bag” Christians; we have been here for generations, for many, many centuries. Those who brand me as a “rice-bag Christian” and speak in such communal terms are doing a great injustice to this country. We are all Indians, and I believe I am a Hindu in a cultural sense—we are all Indians, Bharatiyas. We are traditionally Christian, yes, but we are Indians above all. So, do not speak about communalism.
