Drops of water hollow a stone; persistence pays. Fathima Cashew, an MSME, has almost won the battle after its case was dismissed unjustly umpteen times. Read the order of the Kerala High Court.

Persistence is one principle I firmly believe in: nothing is impossible if you persist. If an objective we seek to achieve is attainable, rational, sensible, legitimate, legal, moral, and ethical, then we must not abandon our efforts, regardless of the hurdles that arise.

Repeated failures naturally make one feel disappointed and tempted to give up on a venture. The present judgment is a classic example: no fewer than 11 cases instituted prior to Proknits v. Canara Bank—claiming the benefit under the notification dated May 29, 2015—were rejected. Justice Bela Trivedi herself had dismissed many such petitions in which I appeared for stressed MSMEs seeking protection under the notification dated May 29, 2015, either offering no reasons beyond stating, “We are not inclined to entertain the SLP,” or offering reasons bordering on absurdity.

Now, who is to be blamed? I am not blaming anyone; I merely wish to point out that the legal fraternity has failed. When a litigant’s legal right is involved, yet the Bench remains reluctant to accept it—and no valid reason is offered for rejecting a contention built on strong legal footing—one must persist, insist, and never give up.

Most litigants have little understanding of how our courts function. They are often in despair and depression, making it difficult for them to maintain hope and persistently pursue their cause. Yet, I have seen litigants—perhaps one in a hundred—who remained persistent, and that persistence has always paid off.

My message to everyone is this: if your goal is achievable, legal, ethical, and moral, then pursue it. Difficulties, hurdles, and failures may come. But if you persevere while maintaining faith in yourself—as Christ said, if you have faith and tell the mountains to move, they will move—no hurdle shall stop us.
