Subject: Request for an audience with Your Excellency in pursuance of the order of the Supreme Court in the matter of registration of an FIR against Justice Varma (Burned Cash at Judge’s Home Scam) – regarding.

 

1.The fact that even after lapse of more than 10 weeks after the recovery of large amounts of cash, burnt and unburnt, at the official residence of Justice Yashwant Varma of the Delhi High Court, no FIR has been registered is a matter of public outcry.

 

2.We approached the Supreme Court, twice, seeking a direction to the Delhi police/CBI to register an FIR and if such a registration requires the prior permission of the CJI – a proposition which is contrary to the very penal laws of the land – even that be granted.

 

3.The Supreme Court, I am afraid to say, has often failed to live up to its constitutional duty and the faith the people of this country have deposed in it, when it comes to the investigation of corruption and other offences involving the judges of the superior courts. In the instant case, the Supreme Court sadly evaded from taking a call, namely, to order registration of an FIR, which it was duty bound. The court instead directed me to make a representation to Your Excellency and the Hon’ble Prime Minister. I have accordingly made a representation to Your Excellency and the Hon’ble Prime Minister, both, on 26.05.2025. Now, i write to seek an appointment in furtherance to the said representation.

 

4.The people of this country are disappointed by the failure of the Supreme Court to uphold the rule of law, to direct the registration of an FIR forthwith. Namely, to bring under the long arms of law whoever involved in the crime, namely the bribe givers, the bribe takers, the fixers, all, for “never be ever so high, the law is above you”.

 

5.The perception is that Justice Verma is not alone, but several people including other judges, are involved. I’m afraid to say, we lawyers earlier used to ask in private, who all are corrupt. Now the question we ask is, who are not? Corruption in the judiciary, particularly, in the higher judiciary is no longer a matter of mere concern. It is now of great alarm. Indeed, frightening.

The direction of the bench headed by Justice A.S.Oka to me, to approach your Excellency and the Hon’ble Prime Minister is a failure to uphold the rule of law.

 

6. However, in hindsight, I consider it to be a blessing in disguise for inscrutable are the ways of the almighty. I consider it be a opportunity mandated by the almighty for me and my fellow petitioners to bring to your Excellency’s personal notice the burning issue of judiciary, namely; corruption, nepotism, inefficiency, wilful denial of justice, inordinate delay in disposal,the total lack of transparency and accountability and so on. Am afraid to say, the tentacles of the cancer of corruption has spread everywhere in the corpus of our judiciary. There can be no denial of that. The scenario dreadful. Justice is in flames today!

 

6 I am sure, your Excellency will be gracious enough to afford an audience to me and fellow petitioners, in spite of our insignificance as early as possible. Because, the issues which we are mandated by the Supreme Court to bring to Your Excellency’s kind notice are of paramount public importance.
